1. Introduction

1.1 Adventure LED Lighting CC t/a Venture 4x4, Registration Number 2003/072674/23 (the Company, we, us or our), respects your privacy and is committed to processing your personal information lawfully and transparently.

1.2 This Privacy Policy explains what personal information we collect, why we collect it, who we share it with, how long we keep it, how we protect it, and what your rights are under the Protection of Personal Information Act, Act 4 of 2013 (POPIA).

1.3 In this Policy, “personal information” and “processing” bear the meanings given to them in POPIA. “You” means the person to whom the personal information relates, whether you are a customer, a supplier contact, a website visitor or a job applicant.

1.4 This Policy forms part of our Website Terms of Use and should be read together with our General Terms and Conditions, published at www.venture4x4.co.za/terms.

2.3 Any request, question, objection or complaint about the way we handle your personal information should be addressed to the Information Officer.

3. The personal information we collect

3.1 Customer and enquiry information: your name and surname, business or trading name, telephone and WhatsApp number, e-mail address, physical and delivery address, and, where applicable, your VAT number and company or close corporation registration number.

3.2 Vehicle information: the make, model, year, variant, registration number and VIN of your vehicle, its odometer reading, its accessories and modifications, and the contents of any job card, quotation, invoice, warranty record or fitment record relating to it.

3.3 Images: photographs taken of your vehicle before, during and after fitment, for inspection, record and warranty purposes, and closed-circuit television (CCTV) footage recorded at our premises.

3.4 Payment and account information: the payment method used, proof of payment, bank reference and account history. Where you apply for a credit account, we may also collect trade references, financial statements and credit-bureau information with your consent.

3.5 Third-party information: where your vehicle is insured, financed or owned by another person, we may collect the name and contact details of that insurer, finance provider, employer or owner, and any claim, authorisation or reference number.

3.6 Website and communication information: your IP address, browser and device type, the pages you view, the date and time of your visit, and information you submit through an enquiry form, live chat, e-mail, WhatsApp or social media message.

3.7 Job applicants: the information you provide in a job application form or curriculum vitae, including your contact details, work history, qualifications, skills, driver’s licence status and references.

3.8 Supplier and business contacts: the names, positions and contact details of individuals at our suppliers, service providers and business partners.

3.9 We do not knowingly collect special personal information as defined in POPIA, and do not require it for our services. Where an insurer, employer or finance provider requires such information, it is collected by them and not by us.

4. How we collect personal information

4.1 Directly from you: when you contact us, request a quotation, place an order, deliver a vehicle to us, complete a job card, register an account, apply for a credit account, apply for a position, or communicate with us by telephone, e-mail, WhatsApp or social media.

4.2 Automatically: through cookies and similar technologies on the Website (clause 9), and through CCTV cameras at our premises (clause 10).

4.3 From third parties: from your insurer, finance provider, employer, broker, assessor or the owner of your vehicle where they instruct or authorise work; from our suppliers and manufacturers in respect of warranty claims; and from credit bureaux where you apply for a credit account.

4.4 Where you give us personal information about another person (for example a driver who will collect a vehicle, or a reference on a job application), you confirm that you are entitled to do so and that they are aware of this Policy.

5. Why we process your personal information

5.1 To perform our contract with you: to prepare quotations, confirm and execute orders, order goods from suppliers, book and carry out fitment, deliver goods, invoice and collect payment, administer deposits and credit accounts, and arrange delivery or courier services.

5.2 To provide after-sales service: to contact you about re-torque and follow-up checks, to administer warranty claims with manufacturers and suppliers, to deal with returns, and to notify you of a product recall or safety notification.

5.3 To comply with the law: to keep accounting, tax and VAT records, to comply with the Consumer Protection Act and POPIA, and to respond to lawful requests from authorities.

5.4 For our legitimate interests: to secure our premises and protect our property, staff, customers and customers’ vehicles; to record the condition of a vehicle on handover; to establish, exercise or defend a legal claim; to recover amounts owing; and to improve our products, services and Website.

5.5 With your consent: to send you direct marketing (clause 11), to publish photographs of your vehicle on our website or social media (clause 6), and for any other purpose for which we ask your permission.

5.6 For recruitment: to assess your suitability for a position, to verify the information you provide, and to contact you about your application.

5.7 We will not use your personal information for a purpose that is incompatible with the purpose for which it was collected, unless you consent or the law permits it.

6. Photographs of your vehicle

6.1 We photograph vehicles at handover, during fitment and on completion as an inspection, record and warranty measure. That processing is necessary for our contract with you and to protect both parties in the event of a dispute.

6.2 We will only publish a photograph of your vehicle in advertising, on our website or on social media with your separate consent, which you may withdraw at any time by contacting the Information Officer. Withdrawing that consent does not affect our right to retain the photograph as an inspection and warranty record.

7. Who we share your personal information with

7.1 Suppliers and manufacturers, where necessary to order a product, obtain fitment or technical information, register a product warranty, or submit and administer a warranty claim on your behalf.

7.2 Couriers, freight forwarders and clearing agents, where goods are delivered or imported.

7.3 Payment processors, banks and, where you apply for credit, credit bureaux and credit providers.

7.4 Insurers, assessors, brokers, finance providers, employers and vehicle owners, where they have instructed or authorised the work or where a claim relates to your vehicle.

7.5 Our professional advisors, including our accountants, auditors, attorneys and debt collectors, where necessary.

7.6 Our service providers, including our website host, IT and software providers, customer-relationship and accounting platforms, communication platforms and marketing providers, who process personal information on our behalf under a written agreement requiring them to keep it confidential and secure.

7.7 Regulators, ombud schemes, courts and law-enforcement authorities, where required or permitted by law.

7.8 We do not sell your personal information, and we do not share it with third parties for their own marketing purposes.

8. Sending personal information outside South Africa

8.1 Some of our suppliers, manufacturers and service providers are located outside the Republic of South Africa, and some of the cloud services we use store information on servers outside the Republic.

8.2 In particular, where a product is imported or a warranty claim is submitted to an overseas manufacturer, your name, contact details, vehicle details and the details of the claim may be sent to that manufacturer in the country in which it operates.

8.3 We transfer personal information across borders only as permitted by section 72 of POPIA, that is where the recipient is subject to a law, binding agreement or corporate rules providing an adequate level of protection, where you have consented, where the transfer is necessary for the performance of our contract with you, or where the transfer is for your benefit and it is not reasonably practicable to obtain your consent.

9. Cookies and website analytics

9.1 A cookie is a small text file placed on your device by a website. We use cookies to make the Website work, to remember your preferences, to understand how the Website is used, and to measure the performance of our advertising. Our analytics and advertising providers are Google Analytics, Google Ads and Meta (Facebook and Instagram).

9.3 Nothing beyond the strictly necessary cookies is set until you accept it. You may change or withdraw your consent at any time using the Cookie Settings link in the footer of every page, or through your browser settings. If you block strictly necessary cookies, parts of the Website may not function properly.

10. CCTV at our premises

10.1 Our premises are monitored by CCTV for the security of our staff, customers, visitors, property and customers’ vehicles, and to record the condition and movement of vehicles in our care. Notices to this effect are displayed at the premises.

10.2 CCTV footage is retained for approximately 30 days and is then overwritten in the ordinary course, unless it is required for an investigation, an insurance claim or a legal proceeding, in which case the relevant footage is retained for as long as necessary for that purpose.

10.3 CCTV footage is accessible only to authorised personnel, and is disclosed to third parties only to the South African Police Service, an insurer, an assessor or a court, where lawful.

11. Direct marketing

11.1 We may send you information about our products, services, specials and events by e-mail, SMS, WhatsApp or automatic calling machine only where you have consented to receive it, or where you are an existing customer, the marketing relates to similar goods or services, and you were given the opportunity to object when we collected your details.

11.2 Every marketing communication we send will identify us and will contain a simple, free means of opting out. You may also opt out at any time by contacting the Information Officer.

11.3 Marketing consent is optional and is never a condition of the supply of goods or services. Opting out of marketing does not stop us from contacting you about your order, your warranty, a re-torque or follow-up check, or a product recall — those are service communications, not marketing.

12. How long we keep your personal information

12.1 We keep personal information only for as long as we need it for the purpose for which it was collected, or for as long as the law requires or permits.

12.2 Accounting, tax and VAT records are retained for the periods required by the Tax Administration Act and the Companies Act, generally five years from the relevant date.

12.3 Job cards, quotations, invoices, fitment records and warranty records are retained for the duration of the applicable warranty and thereafter for the period within which a claim may still lawfully be brought against us, generally three years after the warranty expires.

12.4 CCTV footage is retained as described in clause 10.2. Unsuccessful job applications are retained for 6 (six) months after the position is filled, unless you ask us to keep your details on file for future opportunities.

12.5 Once personal information is no longer required, we delete it or de-identify it in a manner that prevents it from being reconstructed.

13. How we protect your personal information

13.1 We take appropriate, reasonable technical and organisational measures to prevent the loss of, damage to, or unauthorised destruction of personal information, and unlawful access to or processing of it, as required by section 19 of POPIA.

13.2 Those measures include access controls and passwords on our systems, restricted physical access to records and to the premises, confidentiality obligations on our staff, written agreements with our service providers, and regular backups.

13.3 No system is entirely secure. Where there are reasonable grounds to believe that your personal information has been accessed or acquired by an unauthorised person, we will notify you and the Information Regulator as required by section 22 of POPIA.

14. Your rights

14.1 You have the right to be told what personal information we hold about you, and to request a copy of it. We may charge a prescribed fee for providing a copy, and may require proof of your identity before we respond.

14.2 You have the right to ask us to correct or delete personal information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or obtained unlawfully.

14.3 You have the right to object, on reasonable grounds, to the processing of your personal information, and to object at any time to its processing for direct marketing.

14.4 You have the right to withdraw a consent you have given, without affecting the lawfulness of processing carried out before the withdrawal.

14.5 You have the right to lodge a complaint with the Information Regulator (clause 15), and the right to approach a court for appropriate relief.

14.6 To exercise any of these rights, contact our Information Officer using the details in clause 2. Requests for access or correction are made on the forms prescribed under POPIA, which we will provide on request. We will respond within the period prescribed by law.

14.7 Where we cannot act on a request — for example where we are required by law to retain a record, or where a record is needed to establish or defend a legal claim — we will tell you why.

15. Complaints and the Information Regulator

15.1 We would prefer the opportunity to resolve your concern first, so please contact our Information Officer before escalating a complaint.

15.2 You are nonetheless entitled at any time to lodge a complaint with the Information Regulator of South Africa. Complaints are lodged through the Regulator’s eServices portal at eservices.inforegulator.org.za.

16. Changes to this Policy

16.1 We may amend this Privacy Policy from time to time by publishing an updated version on the Website. The version published at the time you access the Website is the version that applies. Where a change materially affects how we use your personal information, we will take reasonable steps to bring it to your attention.
